1. Who we are
Ghost Picker is an independent giveaway tool operated by Maetheon. We are not affiliated with, sponsored by, or endorsed by Snapchat or Snap Inc. Any reference to Snapchat is only to describe what the tool does. In these terms, "we," "us," and "Ghost Picker" mean the operator, and "you" means the user.
2. What Ghost Picker does
Ghost Picker lets you gather the public comments on a Snapchat Spotlight post, filter those entries, and draw a random winner. It can also export a record of your giveaway. The tool works only with publicly available comments on posts you have the right to use.
3. Eligibility and accounts
To use a paid plan, you need to provide a valid email and a working payment method. You're responsible for keeping your account details accurate and your login secure. Anything that happens under your account is your responsibility, so don't share your access with people you don't trust.
You must be old enough to form a binding contract where you live, and old enough to hold a Snapchat account in your region, to use Ghost Picker.
4. Subscriptions, billing, and refunds
Ghost Picker offers subscription plans, currently a monthly Creator plan and a yearly Growth plan. Prices are shown on the pricing page and may change over time. Payments are processed securely through Stripe.
By subscribing, you authorize us to charge your payment method regularly until you cancel. Subscriptions renew automatically at the end of each billing period. You can cancel at any time, and your access will continue until the end of the period you've already paid for.
Unless required by law, payments are generally non-refundable, including for partial periods. If you think you were charged in error, contact us at [email protected], and we'll look into it.
5. Acceptable use
You agree to use Ghost Picker fairly and lawfully. Specifically, you agree not to:
Use the tool to run giveaways that are illegal, deceptive, or that violate Snapchat's own rules and policies.
Scrape or process comments on posts you don't own or don't have permission to use.
Attempt to break, overload, reverse engineer, or interfere with the service or its security.
Use the tool to harvest personal data for spam, harassment, or any purpose unrelated to running a legitimate giveaway.
Resell or redistribute access to Ghost Picker without our written permission.
We may suspend or end your access if you break these rules.
6. Fair draws
The Ghost Picker randomizer is designed to be unbiased, giving every eligible entry an equal chance. That said, you're responsible for how you run and promote your giveaway, including setting clear rules, honoring the prizes you offer, and complying with any laws or platform policies about contests and sweepstakes. Ghost Picker provides the tool; the giveaway itself is yours.
7. Your content and data
You keep ownership of the giveaways you run and the exports you generate. By using the tool, you permit us to process the public comment data needed to provide the service. How we handle data is described in our Privacy Policy.
8. Intellectual property
The Ghost Picker name, site, design, and software are owned by us or our licensors and are protected by law. You may use the service as intended, but you may not copy, modify, or distribute our software or branding without permission.
9. Service availability
We work to keep Ghost Picker running smoothly, but we don't guarantee it will always be available, uninterrupted, or error-free. We may change, pause, or discontinue features at any time. Snapchat may also change its platform in ways that affect how the tool works, and that's outside our control.
10. Disclaimers
Ghost Picker is provided "as is" and "as available," without warranties of any kind, whether express or implied. We don't guarantee that the service will meet every need, produce specific results, or be free of errors. You use the tool at your own risk.
11. Limitation of liability
To the fullest extent allowed by law, Ghost Picker and its operator won't be liable for any indirect, incidental, or consequential damages arising from your use of the service. Where liability can't be excluded, it's limited to the amount you paid us in the twelve months before the claim.
12. Indemnification
You agree to cover us for any claims, losses, or costs that arise from your misuse of the service, your giveaways, or your breach of these terms.
13. Changes to these terms
We may update these terms from time to time. When we do, we'll change the date below. If you keep using Ghost Picker after an update, that means you accept the new terms.
14. Governing law
These terms are governed by the laws that apply to the operator's place of business, without regard to conflict-of-law rules. Any disputes will be handled in the courts of that jurisdiction, unless the law where you live gives you other rights.
